Welcome to the website of JW Baker. By browsing this website, interacting with its features, or purchasing artwork, you agree to the following terms and conditions.
1.) PRIVACY & COOKIES POLICY
Your privacy is deeply important to us. We only collect personal information (such as your name, email address, billing address, and shipping address) that you voluntarily provide to inquire about or purchase artwork. We do not currently operate a marketing newsletter, but we reserve the right to offer an opt-in newsletter in the future.
** Cookies & Tracking ** This website is hosted on the GoDaddy platform. It does not use advanced tracking, behavioral profiling, or advertising cookies. It only uses basic, functional, and security cookies required by GoDaddy to ensure the site operates correctly, securely, and manages shopping cart functions.
** Data Sharing ** We will never sell, rent, or lease your personal information to third parties. Your data is only shared with trusted third-party services (like PayPal and shipping carriers) strictly as needed to process payments and ship your packages.
2.) SALES, PAYMENTS, & RETURN POLICY
**All Sales Final:** All sales of original artwork are final. We do not accept returns, exchanges, or cancellations once an order is placed and payment is processed.
** Payment Processing ** All financial transactions are processed securely through PayPal. We do not store or see your credit card or financial account numbers on our servers.
** Risk of Loss & Insurance ** All artwork is securely packaged and fully insured through the shipping carrier (e.g., USPS, UPS, FedEx). Once the artwork is delivered to the shipping carrier, the legal title and risk of loss or damage pass entirely to the Buyer.
** Shipping Damage Claims ** If your artwork arrives damaged during transit, you must contact us via our Contact Page within 48 hours of delivery. To facilitate an insurance claim with the carrier, the Buyer MUST provide clear photos of the damaged outer packaging, inner packaging, and the damaged artwork, and must retain all packaging materials for carrier inspection. Upon successful verification and approval of the carrier's insurance claim, a remedy (such as a repair, replacement, or refund) will be issued.
3.) ARTWORK REPRESENTATION & COLOR DISCREPANCIES
The Artist attempts to display the colors, textures, and details of physical paintings as accurately as possible on this website. However, because computer monitors, tablets, and mobile screens display colors differently based on individual settings, the Artist cannot guarantee that your screen's display will perfectly match the physical painting. All artwork is sold "as-is" with respect to minor variations in texture, brightness, and digital color representation.
4.) ACCESSIBILITY STATEMENT
We want everyone to enjoy this website. If you are using a screen reader or assistive technology and have trouble navigating the site, or if you would like a detailed description of the interior room staging layouts, frames, or paintings shown in our galleries, please contact us directly via our Contact Page. We will gladly work with you to provide any information you need.
5.) COPYRIGHT & INTELLECTUAL PROPERTY
All images, artwork, text, photography, and designs on this website are the sole intellectual property of JW Baker and are protected by United States and international copyright laws. The purchase of a physical painting DOES NOT transfer copyright or reproduction rights to the Buyer. You may not copy, reproduce, download, screenshot, print, modify, or distribute any images of the paintings for personal or commercial use without explicit, prior written permission from JW Baker.
6.) LIMITATION OF LIABILITY & "AS-IS" DISCLAIMER
This website and all artwork sales are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied.
J W Baker is not responsible for technical glitches, server downtimes, temporary site outages, or typographical errors regarding pricing or inventory descriptions. In the event an artwork is listed at an incorrect price due to a typographical or technical error, we reserve the right to refuse, deny, or cancel the order, even if payment has already been processed (in which case a full refund will be issued).
TO THE MAXIMUM EXTENT PERMITTED BY LAW, J W BAKER’S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM, LAWSUIT, INJURY, OR DISPUTE ARISING OUT OF YOUR USE OF THIS WEBSITE OR THE PURCHASE OF ANY ARTWORK SHALL BE STRICTLY LIMITED TO THE ACTUAL DOLLAR AMOUNT PAID BY THE BUYER TO THE ARTIST FOR THE SPECIFIC TRANSACTION IN QUESTION, OR $100 USD, WHICHEVER IS LOWER. THE ARTIST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING, BUT NOT LIMITED TO, PROPERTY DAMAGE OR EMOTIONAL DISTRESS).
7.) GOVERNING LAW & VENUE
Any legal disputes arising from the use of this website or the purchase of artwork will be governed strictly by the laws of the State of North Carolina, without regard to conflict of law principles. Any legal action, mediation, or court proceeding must be brought exclusively in a state court located in Catawba County, North Carolina.
