Welcome to the website of J W Baker Artist. These policies are intended to make visiting the website and acquiring original artwork directly from my studio clear, straightforward, and secure. By using this website or purchasing artwork through it, you agreeto the applicable terms below.
1.) PRIVACY, COOKIES & THIRD-PARTY SERVICES
Your privacy is important to me.
Personal information provided through purchases, inquiries, or newsletter subscriptions may include your name, email address, billing or shipping information, and other information you choose to provide.
This information is used as reasonably necessary to process transactions, communicate with you, fulfill purchases, provide requested studio communications, and operate J W Baker Artist.
Payment information is processed by the payment provider shown at checkout. J W Baker Artist does not receive or store your complete credit-card or financial account information.
This website may use standard website technologies and third-party services necessary for site operation, analytics, security, payment processing, shipping, or advertising. Those services may use cookies or similar technologies according to their own policies.
J W Baker Artist does not sell, rent, or lease your personal information to third parties. Subscribers to the Studio Letter may unsubscribe from email communications at any time.
2.) ORIGINAL ARTWORK & REPRESENTATION
Unless otherwise stated, artwork offered for sale is an original work created by J W Baker.
Dimensions, medium, price, and other relevant information are listed on each individual artwork page.
Every reasonable effort is made to photograph and represent each artwork accurately. However, screens and devices reproduce color, brightness, contrast, texture, and detail differently. Lighting conditions may also affect the appearance of physical artwork.
For these reasons, the appearance of an original painting may vary slightly from its digital representation. Such normal differences in digital display are not considered defects in the artwork.
Original artwork is sold in its existing physical condition unless otherwise expressly stated.
3.) PAYMENT, PRICING & AVAILABILITY
Payment must be received in full before artwork is released or shipped unless other arrangements have been agreed to in writing.
Once an original artwork has been purchased, it is considered sold and is withdrawn from the market.
Because each original is unique, availability is subject to prior sale.
Reasonable efforts are made to ensure that prices, dimensions, availability, and other information displayed on this website are accurate. However, typographical, technical, or inventory errors may occasionally occur.
If an artwork is mistakenly listed as available after it has sold, or is offered at an incorrect price because of a technical or typographical error, J W Baker Artist reserves the right to correct the error or cancel the affected transaction. If payment has already been processed for a transaction that must be cancelled for one of these reasons, the amount paid will be refunded.
4). SHIPPING & DELIVERY
Complimentary shipping is included with acquisitions within the continental United States unless otherwise noted on the individual artwork page.
Most paintings are professionally packed and shipped fully stretched, wired, and ready to hang.
Shipments are insured as appropriate for the artwork and method of transport. Most standard domestic shipments are sent through UPS. Exceptionally large or otherwise specialized works may be transported by a professional fine-art carrier.
For exceptionally large works, professional fine-art delivery may be arranged so the painting can arrive fully stretched and ready to hang. When specialized delivery is required, arrangements and any applicable additional costs will be discussed with the collector.
5.) INTERNATIONAL COLLECTORS
International acquisitions are warmly welcomed.
Because shipping costs, customs requirements, taxes, import regulations, packaging standards, and carrier requirements vary by destination and artwork size, international delivery is arranged individually.
Depending on the destination and dimensions of the work, a painting may be shipped fully stretched through a professional carrier or carefully rolled for safe transit and professional stretching at its destination.
International collectors should contact the studio before purchase to discuss shipping arrangements and obtain a delivery quote.
Unless otherwise agreed in writing, applicable import duties, taxes, customs fees, brokerage fees, or other charges imposed by the destination country are the responsibility of the collector.
6.) RETURNS, REFUNDS & CANCELLATIONS
All sales of original artwork are final. Returns, exchanges, and refunds are not accepted for change of mind after purchase.
Each painting is a unique original and is withdrawn from the market immediately upon sale. Collectors are encouraged to review artwork images, dimensions, descriptions, and shipping information carefully and to contact me with any questions before purchasing.
If there is a genuine problem with your acquisition, please contact me directly. I want every collector to feel confident in both the artwork and the purchasing experience, and I will work personally with you to resolve legitimate concerns whenever reasonably possible.
Nothing in this policy limits any rights or remedies that cannot legally be waived under applicable law.
7.) SHIPPING DAMAGE & DELIVERY PROBLEMS
The final-sale policy does not prevent a collector from contacting J W Baker Artist regarding artwork damaged during transit or an error made by the studio.
Artwork is insured during shipment as appropriate to its method of transport.
Please inspect your shipment promptly upon delivery.
If the package shows visible signs of damage, photograph the unopened package before opening it whenever possible.
If the artwork has been damaged during transit, please contact me promptly and retain:
• the artwork
• the outer shipping container
• all interior packing materials
• shipping labels and documentation
• photographs showing the packaging and damage
These materials may be required by the shipping carrier or insurer to investigate and process a claim.
Please do not discard packaging or return damaged artwork without contacting me first.
I will work directly with you to coordinate the appropriate carrier or insurance claim and determine the appropriate resolution.
8.) COPYRIGHT & INTELLECTUAL PROPERTY
Purchase of an original artwork transfers ownership of the physical artwork only.
Copyright and all reproduction, publication, licensing, merchandising, and other intellectual-property rights remain with
J W Baker unless those rights have been expressly transferred in a separate written agreement.
Purchasing an original artwork does not grant permission to reproduce, publish, commercially exploit, manufacture merchandise from, license, or otherwise commercially use the artwork or its image.
Collectors are welcome to photograph and share their artwork for ordinary personal, non-commercial purposes. Credit to
J W Bakeris always appreciated.
All original artwork images, photography, text, graphics, designs, and other original content appearing on this website are protected by applicable copyright and intellectual-property laws.
Website content may not be reproduced, distributed, published, modified, commercially exploited, or used to create derivative commercial products without written permission from J W Baker.
9.) ARTWORK IN ROOM SETTINGS
Room settings and interior visualizations on this website are created to help collectors and designers imagine artwork within an environment.
The artwork shown in these visualizations is based on photographs of the actual painting, while the surrounding room may be digitally created, digitally altered, or otherwise created for presentation purposes.
These images are intended for visual inspiration and presentation, not precise architectural or scale accuracy.
The apparent size of a painting within a room visualization may differ from its actual dimensions. Furnishings, walls, windows, and other elements shown in a visualization should not be used as measurement references.
Always refer to the published dimensions of the artwork and measure your intended display space before purchasing.
It is the purchaser's responsibility to confirm that an artwork will fit the intended location. J W Baker Artist is not responsible for sizing or placement issues resulting from reliance on a room visualization rather than the published artwork dimensions.
10.) ACCESSIBILITY
J W Baker Artist is committed to making this website reasonably accessible and usable for all visitors, including people with disabilities.
Ongoing efforts are made to improve the accessibility and usability of the website. Because websites may incorporate different technologies, third-party services, and external payment systems, individual experiences with assistive technologies may vary.

11.) WEBSITE AVAILABILITY & ERRORS
Reasonable efforts are made to keep this website accurate and available.
J W Baker Artist is not responsible for temporary website outages, server or hosting interruptions, third-party service failures, browser or device incompatibilities, or other technical problems outside the studio's reasonable control.
Information on the website may occasionally contain typographical or technical errors. J W Baker Artist reserves the right to correct such errors when discovered.
12.) LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, J W Baker Art will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the use of this website, the purchase of artwork, or matters relating to shipment or delivery, including claims for emotional distress, except where such liability cannot legally be limited or excluded.
To the fullest extent permitted by applicable law, J W Baker Artist's aggregate liability arising from a particular purchase will not
exceed the amount actually paid to J W Baker Artist for the transaction giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
13.) GOVERNING LAW & DISPUTES
These Terms and purchases made through J W Baker Artist are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles, except where applicable law requires otherwise.
If a dispute arises, the parties are encouraged to first make a good-faith effort to resolve the matter directly before initiating formal legal proceedings.
To the fullest extent permitted by applicable law, legal proceedings arising from these Terms or a purchase from J W Baker Artist shall be brought in an appropriate court located in North Carolina.
Nothing in these Terms limits any consumer right, remedy, jurisdiction, or venue that cannot legally be waived.
14.) SEVERABILITY & NO WAIVER
If any provision of these Terms is determined to be invalid, unenforceable, or contrary to applicable law, that provision will be limited or removed only to the extent necessary. The remaining provisions will continue in effect.
If J W Baker Artist chooses not to enforce a provision of these Terms in a particular circumstance, that does not constitute a waiver of the right to enforce that provision in another circumstance.
15.) CHANGES TO THESE TERMS
These policies may be updated periodically to reflect changes in studio practices, website services, shipping procedures, technology, or applicable requirements.
The version posted on this website at the time of purchase will govern that transaction unless otherwise required by applicable law.
